METHODOLOGY FOR MEASURING CONSTITUTIONALISM EVALUATION INDICATORS
The main topic of the seminar was the measurement of constitutionality assessment indicators. In the modern literature there is no unified approach to quantitative assessment of constitutionalism level.
The complexity of implementing similar assessments is conditioned by the multidimensionality of the constitution, multiplicity of structural and research methodologies of its components, interpretation of results, as well as interim and inter-regional comparability.
Therefore, for the most efficient presentation of the information is necessary to construct a composite index characterizing the constitutional level, which will allow to carry out quantitative assessment, compare the latter's level in different countries and different years, diagnose the main problems and substantiate quantitative assessments and increase the effectiveness of the decision-making process.
The second part of the seminar referred to the classification of indicators for monitoring the level of Constitutionalism.
According to the quantitative assessment method this classification is as follows:
Binary– the indicators of this class evaluate the existence or absence of a certain constitutional norm in this or that legal act.
Objective- the indicators of this class evaluate the actual situation in each country, from the point of view of international organizations, as a result of implementation of the constitutional provisions.
Effective - the indicators of this class evaluate the perception of the effectiveness of the implementation of constitutional norms by experts.
The speaker also presented the main constituent elements for monitoring the level of Constitutionalism process.
